1. BINDING AGREEMENT

Any order, quotation, or purchase agreement facilitated by or on behalf of Water Systems Australia (WSA) is strictly governed by these Terms and Conditions. Proceeding with a transaction constitutes full legal acceptance of this contract.

2. LEGAL CAPACITY

By engaging our services, you confirm that you are over 18 years of age (or have explicit parental consent) and possess the legal standing to enter into a binding financial contract under Australian law.

3. PRODUCT DEFINITIONS

“Products” refers to the water filtration units and hardware specified in your quote. “Standard Installation” covers connections to pre-existing, compliant Australian plumbing. “Supply Only” implies WSA is responsible only for hardware delivery and product-specific warranties.

4. FINANCIAL OBLIGATIONS & PAYMENT TERMS

Ownership of all goods remains with WSA until the full invoiced amount is cleared. This retention of title is registered under the Personal Property Securities Act (PPSA). Payments are required upon installation unless an authorized finance plan is active.

Late Payment Fees: Payments overdue by more than 14 days will incur a late fee of $50 plus interest at 2% per month on the outstanding balance.

Finance Options: If utilizing third-party finance (e.g., Zip, Afterpay, or bank financing), all credit terms are subject to the finance provider’s Terms and Conditions. WSA is not the credit provider. Please refer to your finance agreement for interest rates, fees, and total amount payable.

5. 2-YEAR LIMITED WARRANTY

WSA warrants the filtration hardware and installation workmanship for a period of 2 years from the date of service. This warranty protects against manufacturing defects in materials and workmanship. Consumable items (filter cartridges) are excluded as they require regular replacement to maintain water quality.

6. WARRANTY EXCLUSIONS

The warranty may be voided if the system is serviced, moved, or tampered with by an unauthorized technician, or if damage results from lack of maintenance, extreme water pressure spikes, plumbing failures outside WSA’s control, or misuse. However, this does not affect your rights under Australian Consumer Law (see Section 10).

7. INSTALLATION & ACCESS

The client must ensure a safe working environment and clear access to the installation site. WSA reserves the right to charge a call-out fee of $150 if an installation cannot proceed due to site obstructions, non-compliant pre-existing plumbing, or customer unavailability at the scheduled time.

8. MAINTENANCE REQUIREMENTS

To ensure water purity and optimal system performance, filters must be replaced at the intervals specified by WSA (typically every 6-12 months depending on usage and water quality). Regular maintenance is recommended to prevent system degradation. Note that failure to maintain the system may void warranty claims if the lack of maintenance directly caused the failure.

9. UNCAPPED REFERRAL REWARDS

Our rewards program is incremental and uncapped. A reward is credited once a referred party successfully completes their installation and payment. Reward tiers increase with the volume of successful referrals. Contact us for current reward structure details.

10.AUSTRALIAN CONSUMER LAW GUARANTEES

IMPORTANT: The sale of Products by WSA is subject to Australian Consumer Law (ACL), which is Schedule 2 of the Competition and Consumer Act 2010. Our Products come with guarantees that cannot be excluded under the ACL.

You are entitled to:
• A replacement or refund for a major failure
• Compensation for any other reasonably foreseeable loss or damage
• Have the Products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure

A “major failure” is broadly defined as a failure where a reasonable consumer would not have acquired the Products had they been fully aware of the failure, the Products are unsafe, substantially unfit for their intended purpose, or departed significantly from the description, demonstration model, or sample.

Liability Limitation: To the extent permitted by law, WSA’s total liability for claims not covered by ACL guarantees is limited to the cost of repairing or replacing the goods, or supplying equivalent goods. We are not liable for consequential losses or indirect damages except as required by the ACL.

11.Governing Law & Jurisdiction

These terms are governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales for any legal proceedings arising from this agreement.

12.Dispute Resolution

If you have a complaint or dispute, please contact us first using the details below. We will endeavor to resolve the matter internally within 30 days. If you are not satisfied with our response, you may lodge a complaint with:

  • Australian Competition and Consumer Commission (ACCC): www.accc.gov.au

13.Force Majeure

WSA is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, strikes, supply chain disruptions, or government restrictions.

14.Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15.Entire Agreement

These Terms constitute the entire agreement between you and WSA regarding the Products and Services, and supersede any prior agreements or understandings, whether written or oral.

16.Amendments

WSA reserves the right to update these Terms from time to time. Changes will be posted on our website with an updated “Last Updated” date. Continued use of our Services after changes constitutes acceptance of the revised Terms.
